Driving While License Suspended / Revoked / No License

Driving While License Suspended / Revoked / No License

In Illinois there are dozens of reasons that a person may lose his or her license. Additionally, whether a person is legally allowed to drive is not up to the court- it is decided by the Illinois Secretary of State. The legislature has made a list of reasons where the Secretary of State is allowed to suspend, cancel or revoke a driver’s license or permit. They have also outlined when the Secretary of State is required to suspend, cancel or revoke a driver’s license or permit.

However, the courts and the Secretary of State are related: things that happen in court get reported to the Secretary of State and the latter will take action as directed by the legislature. For example, if a person is convicted of a certain offense in court, the conviction will get reported to the Secretary of State and it may revoke or suspend the person’s license, depending on the circumstance.

Some of the more common reasons for suspension or revocation include:

  • Conviction for DUI
  • Arrest for DUI
  • Underage consumption or possession of alcohol
  • Conviction for driving without a license
  • Conviction for driving without insurance
  • Past due child support
  • Accident judgements
  • Driver’s license fraud

The seriousness of driving without a license many times depends on the cause of the suspension or revocation. For example, a charge of driving while license suspended following a DUI conviction is taken more seriously than a suspension based on other causes and may even be charged as a felony.

When Harter & Schottland represents a person who was ticketed or arrested for driving without a license we look at the record to determine the basis of the loss of driving privileges. In many instances we can clear the suspension or revocation. This helps our client in two ways: First, the restoration of driving privileges is a significant benefit to our client. Secondly, the outcome we obtain in court many times is much better if we can demonstrate to the court that we take the situation seriously and have corrected the underlying problem

If your driver’s license is revoked, suspended or cancelled, call Harter & Schottland. We have a long track record of success in license reinstatement.

At Harter & Schottland, we help clients get their driver’s licenses back. If you have a canceled, suspended or revoked driver’s license, we will lead you through the legal and administrative steps necessary to get you back on the road so that you can once again drive legally. We will make it easy and quick. Don’t wait- it’s time to get your driver’s license back.”
