Working the Case

Next, we will obtain and study the police report, the results of the Breathalyzer test, and all other information collected by the authorities in your drunk driving arrest. We may file a motion to suppress evidence or arrest from being used against you. We may challenge whether the officer had probable cause to make the stop or proper training to administer the breath test or field sobriety tests. We will defend your constitutional rights.

A first offense DUI is a Class A misdemeanor, punishable by up to a year in jail, a $2,500.00 fine plus court costs and at least a 6 month statutory summary suspension of your driving privileges. In some cases your driver's license can be suspended for up to three years, or permanently revoked. We may also file a petition to rescind the statutory summary suspension to challenge the suspension of your driver's license. We will file a Petition for an MDDP (Monitored Device Driving Permit) which allows you to drive unlimited however requires a BAIID Device to be installed in your vehicle.

This permit is only available to those who are considered first time offenders. Generally, this includes offenders who have not had a previous DUI disposition (including supervision, conviction or statutory suspension) within five (5) years of the current arrest.
